The procedure


When you submit a dispute, the official procedure begins. This means that you have already attempted to resolve the complaint in consultation with the entrepreneur. The procedure consists of three phases, with the third and final phase concluding in a ruling by one of our binding advisors. At each phase, there is still an opportunity to reach a mutual agreement.

Costs

UitspraakZaak.nl charges consumers a fee for handling a complaint. The amount of the handling fee varies depending on the phase of the procedure. Entrepreneurs also pay handling fees, depending on the outcome of the dispute. Entrepreneurs can request the rates from their trade association.

Prior to each phase, the consumer pays the treatment costs for the relevant phase via a simple iDeal transfer. Once the payment is received, the dispute or the next phase will begin.

Depending on the ruling of the binding advisor, the consumer may receive (part of) the treatment costs paid back from the entrepreneur. The foundation does not reimburse the treatment costs. However, the costs paid by the consumer may become part of the negotiations with the entrepreneur. It is up to the parties to reach an agreement on this together.

Outstanding invoice

It is possible that the consumer has not yet paid the full amount to the entrepreneur. In that case, the consumer must first deposit the outstanding amount with UitgesprokenZaak.nl before the dispute can be handled. The deposit will be held in a third-party account, meaning no one can access it. The deposit amount will only be refunded or paid out if the consumer agrees to this with the entrepreneur in a settlement or if the binding advisor decides this in the binding advice.

Costs for entrepreneurs

The entrepreneur also pays a contribution to the costs of the treatment. The costs depend on the phase of the procedure and the way in which the dispute is resolved. An overview of these costs can be found on the website of the trade association.
